GotAI Terms of Service and Fair Use Policy

1. Overview

GotAI provides an AI phone answering service for tradespeople and small businesses.

The service is designed to answer missed or unanswered business calls, collect basic caller information, and send the customer enquiry to the business owner by SMS and/or email.

GotAI is intended to help businesses capture missed enquiries. It is not a replacement for emergency services, legal advice, medical advice, financial advice, or professional judgement.

Business use only. GotAI is supplied for business use only. By using the service, the customer confirms that they are acting in the course of a trade, business, craft, or profession, and not as a consumer. This agreement is a business-to-business contract. The customer should not use GotAI for personal, domestic, or household purposes. Nothing in these terms excludes or limits any mandatory rights that cannot legally be excluded.

2. Trial Period

GotAI may offer a 14-day free trial.

During the trial, the customer can test the service before continuing with a paid subscription.

Unless cancelled before the end of the trial, the subscription will continue at the agreed monthly price.

The current standard subscription for the Irish market is:

Pricing in other currencies or markets, where offered, is as agreed in writing and confirmed on the customer’s payment link.

3. What the Service Does

4. Customer Responsibilities

The customer is responsible for:

GotAI cannot capture calls unless the customer correctly enables call forwarding.

5. Conditional Call Forwarding

The customer normally needs to enable conditional call forwarding so that calls are sent to GotAI when:

GotAI may assist the customer with setup, but the customer remains responsible for activating the forwarding on their own mobile network or phone service.

Forwarding costs. The customer is responsible for any mobile network, carrier, call forwarding, roaming, or diverted-call charges applied by their own phone provider. GotAI is not responsible for charges the customer’s network applies for forwarding or diverting calls to the GotAI number.

6. Fair Use Policy

The standard GotAI monthly plan includes up to:

300 AI call minutes per monthly billing period.

This allowance is intended to cover normal business use for a sole trader or small business.

How minutes are counted. AI call minutes are counted from when the GotAI agent answers a forwarded call until the call ends. Partial minutes may be rounded up where GotAI’s providers bill on that basis. Unused minutes do not roll over to a later billing period.

Example: If a customer receives around 50 missed calls per month, and each AI-handled call averages 3-5 minutes, the 300-minute allowance should normally be sufficient.

7. Excessive Usage

If the customer exceeds 300 AI call minutes in a monthly billing period, GotAI may take one or more of the following actions:

Any additional usage charges, or any change to the fair-use limit, apply only where agreed in writing in advance. GotAI will not impose overage charges without the customer’s prior written agreement, and will not intentionally allow excessive usage to continue without notifying the customer.

8. Abuse and Misuse

The customer must not use GotAI for:

The customer must not forward, or direct to GotAI, any line intended for emergency, medical, safety-critical, or regulated use. This includes, without limitation, emergency services and 999/112, out-of-hours medical or care lines, alarm or monitoring lines, gas-leak or utility-emergency lines, crisis or vulnerable-person helplines, and lines used to provide legal, financial, medical, or other regulated advice. GotAI is not an emergency dispatch, triage, or safety service, and must not be treated as a substitute for professional regulated advice.

GotAI may suspend or terminate service immediately if misuse is suspected.

9. Accuracy of AI Responses

GotAI uses AI technology to answer calls and collect information.

The customer understands that AI systems may occasionally:

The customer should verify important details directly with the caller before relying on them.

GotAI’s purpose is to improve missed-call capture, not to guarantee perfect transcription or decision-making.

10. SMS and Email Notifications

GotAI may send enquiry notifications by SMS and/or email.

Delivery depends on third-party providers, mobile networks, email providers, spam filters, mailbox storage, and other systems outside GotAI’s full control.

GotAI is not responsible for missed notifications caused by:

If a notification is missing, the customer should check the items above and contact GotAI before assuming a service fault.

11. Payments

Payments are processed through Stripe or another approved payment provider.

GotAI does not store the customer’s card details.

The customer is responsible for cancelling the subscription if they do not wish to continue after the trial period.

12. Cancellation

The customer may cancel future billing through the Stripe customer portal where available, or by emailing GotAI before the next billing date. Cancellation takes effect at the end of the current paid period unless GotAI agrees otherwise in writing.

Cancellation stops future billing but does not automatically refund previous payments unless agreed separately in writing.

Deleting call forwarding or stopping use of the service does not automatically cancel billing. The customer must cancel as described above to stop future charges.

If the customer cancels during the free trial, no subscription payment should be taken.

13. Refunds

Refunds are not automatic.

GotAI may consider refunds on a case-by-case basis, especially where:

Refunds are generally not provided where the customer failed to enable call forwarding, provided incorrect contact details, or did not use the service.

14. Data Handling and Privacy

GotAI may process caller information such as:

This information is used to provide the service to the customer.

GotAI will take reasonable steps to protect customer and caller information. The customer should not use GotAI to collect highly sensitive or special-category personal data unless specifically agreed in writing.

Controller and processor roles. For caller enquiry data processed on behalf of the customer, the customer is normally the data controller and GotAI acts as processor. For GotAI account, billing, support, security, abuse prevention, and service administration data, GotAI acts as data controller. The GotAI Data Processing Agreement (DPA), published at gotai.ie and incorporated into these terms, sets out the processor obligations in full. A full explanation - what is and is not collected, how long it is kept, the third parties involved, data-subject rights, and controller/processor roles - is set out in the GotAI Privacy Policy, which forms part of these terms.

Call recording and caller notice. Calls handled by GotAI may be recorded, transcribed, or analysed by AI in order to produce the enquiry summary the customer receives. Where a call may be recorded, GotAI plays a short notice to the caller at the start of the call, for example: “This call may be handled by an AI assistant and may be recorded or transcribed so we can pass your enquiry to the business. Please continue if you are happy to proceed.” If a caller does not wish to continue with an AI-handled, recorded, or transcribed call, they may end the call and contact the customer directly by another method. The customer authorises GotAI to record, transcribe, and summarise calls for this purpose on the customer’s behalf, and is responsible for ensuring that forwarding their line to GotAI does not breach any recording-consent or caller-notice rule that applies to their business, industry, or jurisdiction. Where appropriate, the customer should also disclose that calls may be AI-handled or recorded on their own website, voicemail greeting, or customer-facing materials. The customer must inform GotAI if their business is subject to special recording or notification rules. Retention periods for recordings are stated in the call notice and set out in the GotAI Privacy Policy.

15. Third-Party Services

GotAI may rely on third-party services for:

GotAI is not liable for outages, delays, or failures caused by third-party providers, but will make reasonable efforts to restore or reroute service where possible.

16. Service Availability

GotAI aims to provide a reliable service but does not guarantee uninterrupted availability.

The service may be unavailable due to:

No service level agreement unless separately agreed. Except where GotAI and the customer agree a specific service level agreement (SLA) in writing, GotAI provides the service on a reasonable-endeavours basis only. GotAI gives no warranty or guarantee as to uptime, availability, response time, answer rate, lead capture rate, accuracy of summaries, or the number of calls captured, and is not liable for missed calls or missed enquiries resulting from any of these factors.

17. Limitation of Liability

GotAI is designed to help capture missed business enquiries.

GotAI is not liable for:

The customer remains responsible for managing their own business communications.

Total liability cap. To the maximum extent permitted by law, GotAI’s total aggregate liability arising out of or in connection with the service is limited to the fees paid by the customer to GotAI in the three monthly billing periods immediately before the event giving rise to the claim.

Non-excludable liability. Nothing in these terms excludes or limits GotAI’s liability for fraud, wilful misconduct, death or personal injury caused by negligence, or any other liability that cannot legally be excluded or limited.

18. Indemnity

The customer agrees to indemnify GotAI against any claims, losses, complaints, fines, costs, or expenses arising from the customer’s misuse of the service, unlawful forwarding of calls, failure to provide any required notices, collection of prohibited sensitive data, or use of GotAI for emergency, safety-critical, regulated, fraudulent, or unlawful purposes.

19. Changes to the Service

GotAI may update the service, features, fair use limits, or these terms over time.

Pricing changes. Any change to pricing applies from the next renewal or billing period, unless otherwise agreed in writing. Pricing changes do not affect fees already paid for the current billing period. Where practical, GotAI will give active customers reasonable notice of material pricing changes.

20. Termination

GotAI may terminate or suspend service if:

21. Dispute Resolution and Governing Law

If a dispute arises, the customer agrees to contact GotAI first so that both parties can try to resolve the matter informally and in good faith.

If the dispute cannot be resolved informally within 14 days, either party may propose mediation or arbitration, but arbitration will only apply where both parties agree to it in writing at the time of the dispute.

Nothing in these terms prevents either party from using the Irish courts where they are legally entitled to do so.

These terms are governed by the laws of Ireland. The parties submit to the exclusive jurisdiction of the courts of Ireland.

22. Acceptance

By signing up for GotAI, starting a trial, making payment through Stripe, or using the service, the customer accepts these Terms of Service and Fair Use Policy and the GotAI Privacy Policy. The customer confirms that they are a business acting in the course of a trade, business, craft, or profession, and not a consumer, and that they accept these terms as a business-to-business agreement.

Acceptance record. Before the service is activated, the customer must confirm acceptance of:

  1. These Terms of Service and Fair Use Policy.
  2. The GotAI Privacy Policy.
  3. The call recording and transcription notice.
  4. The 300-minute fair-use limit per monthly billing period.
  5. The cancellation and refund terms.

The minimum viable acceptance confirmation is: “I confirm I am accepting GotAI’s Terms of Service, Fair Use Policy, and Privacy Policy for business use.” GotAI aims to record the date, customer name, email, mobile number, and the version of these terms that was accepted.


Customer Setup Confirmation

To activate GotAI fully, the customer must:

  1. Enable conditional call forwarding to the GotAI phone number provided.
  2. Confirm their notification mobile number.
  3. Confirm their notification email address.
  4. Allow GotAI to run a test call.
  5. Confirm that the SMS and/or email notification was received.

Until call forwarding is enabled, GotAI cannot answer missed calls on behalf of the customer. GotAI will guide the customer through the setup, including the forwarding codes, a test call, and confirming that notifications are received.


Plain-English Summary

GotAI is a business service. It answers missed business calls and sends the enquiry to you by SMS or email.

The standard Irish plan is €29.95/month for the first 3 months, then €49/month, and includes 300 AI call minutes per monthly billing period. Overage charges apply only if you agree them in writing.
